  1. New Zealand Health Association Limited trading as Sanitarium Health Food Company of 124 Pah Road, Royal Oak, Auckland 1023, New Zealand ("Sanitarium"), owns this website. Sanitarium, in conjunction with Magnet Design operates this website.
  2. Definitions
    • Customer means you and all other persons who purchase the products under your name.
    • Delivery address: means the address the Customer specifies to Sanitarium for delivery.
    • GST: means goods and services tax chargeable in accordance with the Goods and Service Tax Act 1985.
    • Products: means the products for sale on the Sanitarium New Zealand 2010 Weet-Bix Tryathlon Official Site .

  4. These Terms and Conditions incorporate the Sanitarium New Zealand 2010 Weet-Bix Tryathlon Official Site Privacy and Security Policy. You should read this Policy in conjunction with these Terms and Conditions. Please weetbix@saniatirum.co.nz and we will advise you as to when that product will become available or if stocks have run out.
  5. Product quality: If Sanitarium agrees that a Product was delivered to a Customer in a damaged condition, Sanitarium shall, at the request of the Customer, replace or refund the value of the Product to the Customer.
  6. Payment: Customers must pay Sanitarium for the Products purchased by credit card. Sanitarium does not accept EFTPOS, cash, cheque, voucher or any other form of payment. If a customer’s credit card is declined by its financial institution, delivery of the order will not be made, and Sanitarium will contact the Customer to make alternative payment arrangements. Sanitarium reserves the right to refuse to accept payment from any particular Customer by credit cards for any reason whatsoever. If a Customer is invoiced an incorrect amount for any Product ordered, Sanitarium shall be paid, or refund to, the Customer the necessary adjustment amount to reflect the correct amount which should have been invoiced. The Customer is liable for any debt collection costs associated with any payment default for any order.

  8. Returns policy: Sanitarium will provide an offer to replace goods that are deemed faulty or for incorrect products delivered. Sanitarium reserves the right to assess any claim for replacement or refund before accepting any claim. Where goods are faulty or if the Customer has been sent the wrong item, Sanitarium will reimburse the Customer for reasonable postage paid. Sanitarium does not accept returned purchases because the Customer has changed their mind.
  9. The Customer may vary or cancel the order up to the point in time that Sanitarium has commenced packing the order by contacting Customer Services.
  10. Correct Address: The Customer shall make sure that the correct postal address in included. Sanitarium will not be responsible for goods that do not reach the Customer due to an incorrect delivery address being provided.
  11. Delivery: Sanitarium reserves the right to withhold delivery of any products to a Customer for any reason whatsoever. Deliveries will be made to the address specified by the Customer and might take up to 28 days. The Customer shall notify Sanitarium immediately of a change to its delivery address. Notwithstanding any other term, Sanitarium shall not be liable for failure to deliver on a timely basis, whether the delay has been due to causes beyond the control of Sanitarium or otherwise. If Sanitarium considers that the delivery of a Customer’s order is likely to be substantially delayed, Sanitarium may, but shall not be obliged to, contact the Customer to arrange an alternative delivery timeframe. If that timeframe is unacceptable to the Customer, the Customer may cancel the order, without incurring a fee for doing so. The Products will be deemed to have been delivered when they are left at the delivery address specified by the Customer, whether or not he Customer is present to receive the Products ordered.
  12. Sanitarium shall not be liable for any lost, stolen or misdirected postage of goods. Sanitarium will make all reasonable endeavours to locate such post but will not be responsible for any loss, direct, indirect, incidental, special, consequential or exemplary damages as a result of that loss.
  13. Property and risk in the products shall pass to the Customer on delivery to the delivery address.
  14. Liability: Sanitarium, its owners, subsidiaries, officers, agents and employees will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered in connection with purchasing any Sanitarium New Zealand 2010 Weet-Bix Tryathlon Official Site products in any way except for liability which cannot be excluded by law. Any liability of Sanitarium whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in, or non-compliance of, a Product or any other breach of Sanitarium’s obligations hereunder, shall not in any event exceed an amount equivalent to the price of the relevant Product.
  15. The Customer agrees to indemnify Sanitarium against all liabilities, losses, claims and expenses suffered or incurred by Sanitarium, and all claims and demands made against Sanitarium, arising directly or indirectly out of the Customer’s use of the website, any breach of these Terms and Conditions, or the delivery or failure to deliver any products. The Customer agrees to indemnify and hold Sanitarium and its subsidiaries, officers, agents and employees harmless from any claim or demand made by any third party due to or arising out of the Customer’s use of this website,

Consumer Guarantees Act 1986: The Customer acknowledges that where the Products are ordered for business purposes, the provisions of the CGS shall not apply to the sale of the Products by Sanitarium. The Customer agrees that nothing in these Terms and Conditions in intended to have the effect of contracting out of the provisions of the CGS except to the extent permitted by the CGA, and all provisions of these Terms and Conditions shall be read as modified to the extent necessary to give effect to that intention.
  17. Warranties: All representations, warranties, terms, guarantees, or conditions whether implied by statute, common law or custom of the trade or otherwise, including, but not limited to, implied warranties, guarantees or conditions of merchantability and/or fitness for purpose, tolerance to any conditions or similarity to sample are excluded to the fullest extent permitted by law. The Customer acknowledges that the Customer does not rely on any representations or statement made by or on behalf of Sanitarium other then the express provisions of these Terms and Conditions. The Customer shall ensure that the Products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the Products. The Customer expressly acknowledges and agrees that Sanitarium assumes any obligation or liability for any advice given, and that all such Products are accepted by the Customer entirely at the Customer’s risk.
  18. Security: When using credit cards in our secure check-out your personal information is scrambled as it travels over the web so that others cannot tap into your details. However, we cannot completely guard against the risk of others gaining access to these details, although we make reasonable efforts to do so. As such Sanitarium will not be liable for a third party gaining your credit card details through the purchase of a product on this website. Sanitarium will not be responsible for any loss, direct, indirect, incidental, special, consequential or exemplary damages as a result of that loss.

Intellectual Property: All material and content on this website, including but not limited to any and all trademarks, service marks, designs, products, software, images, sound and video recordings (whether streaming or downloadable), content downloads, and other audio/visual materials, are subject to protection under copyright, trademarks and/or other intellectual property laws, and are the property of Sanitarium or used by Sanitarium under licence by the relevant owner. Any unauthorised use of such intellectual property is prohibited and is a breach of these Terms of Use.
  20. Force Majeure: If the performance by Sanitarium of its obligations under these Terms and Conditions is prevented by reason of “force majeure” (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of any government or governmental agency, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of Products or raw materials, delay in transit, electricity or communications failures, or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of Sanitarium, Sanitarium shall be excused from such performance to the extent of such prevention.
